Why is this needed?

 The Research In Motion (RIM) BlackBerry is an essential tool for business communications. For many, the BlackBerry is a portable office considering one can:

  • Send email
  • Make phone calls
  • Check voicemail
  • Send SMS/Text messages
  • Send PIN messages
  • Communicate using Instant Messages
  • Browse the Internet

While this has greatly increased office productivity, it has created a  dramatic loss of control for companies that, by law, need to monitor employee-customer communications.


Why worry about it?

Companies in the finance industry can face a huge corporate liability. In 2002 the SEC handed down fines of 8 million dollars to companies that did not archive employee email. These firms did not consider that the SEC 17A-4 and NASD 3010 regulations applied to email communications

The SEC has updated their regulations to include computer based Instant Messaging, as provided by AOL, Yahoo, MSN and Reuters, as part of the SEC 17A-4 mandate.

And, most recently, the SEC has included the additional communication channels provided by the BlackBerry under the 17A-4 statute.

 

Many IT managers were told that it was not possible to archive these forms of BlackBerry-specific communication.
